Tippecanoe County 79-5

Jurisdictions: City of Lafayette, Fairfield Township

Topic: Wastewater disposal

Date: 1988 July

Purpose: To alleviate the problems involving the disposal of wastewater and surface water drainage from the area including Crouch School. (P. 1)

Function: Public works/transportation, Disposal of wastewater

Type: Collaboration

Organization: Joint agreement. No governing board. Single supply: City will build sewer systems in an area that, it seems, the Township has some responsibility for. The agreement says that the Crouch School was built by Township but there is present litigation about the ownership of said school grounds (P. 1). Also, it seems that Crouch Community is part of Township but that the "peculiar" situation there may adversely affect the City. (P. 2) Township will pay City for its services.

Services delivered: City will implement and finish the proposed project (project is described in an Attachment, which is not found in our copy of the agreement). (P. 2) City will reduce the health, drainage, safety, and traffic problems of the Vinton Woods area and the Crouch Community area by installing sanitary sewers and storm sewers. (P. 2) City will accept as City streets the 3 streets now known as Willow Drive, Melody Lane, and Longacre Drive. (P. 2) City agrees to accept any offered easements (rights of way) consistent with the proposed plan at a value sufficient to reduce the total costs to any property owner connecting to the sanitary sewer, not to exceed $1,000. City will incur expenses to the edge of the new City easement for each new connection. From that point on, costs for connection (on the respective property owner's own property) is that property owner's sole obligation. (P. 2)

Financing: Township will contribute $25,000, which represents a portion of the monies which would normally be contributed as the "contiguous land owner's" share for improvements. (P. 1)

Liability: City will hold harmless the Trustee and each Township Board member individually for any claims resulting from this agreement. (P. 2)
