Topic: Development of roads, water systems, and sewers

Purpose: To develop roads, water systems, and sanitary sewers and storm sewers for the I/N Tek Steel Plant which is to be newly constructed at a site in western St. Joseph County. Commitment to make infrastructure improvements was a necessary precondition for the I/N Tek selection of this site. (P. 1)

Type: Collaboration

Organization: Multiple-party agreement. Governed by the Joint I/N Tek Governmental Board. Multiple supply: County is responsible for the financing and construction of the three projects. City and Town will be responsible for the maintenance of the sewer system and water system, respectively. Road system will be maintained by County.

Duration: 4 years. (P. 3)

Services delivered: County will design and construct the road system, sanitary sewer system, and water system; this includes entering into the necessary construction contracts, obtaining rights-of-way, environmental studies, handling payments to contractors, etc. (a long list is provided). The construction inspection process of the sewer system is to be handled by the City. Upon completion of the sanitary sewer system, the system and all necessary rights-of-way shall be deeded by County to the City. All maintenance will at that time be taken over by City. The construction inspection process of the water system is to be handled by the Town's contractors. Upon completion of the water system, the system and all necessary rights-of-way shall be deeded by the County to the Town. All maintenance of the system will at that time be taken over by the Town. Financing: County shall pay for the construction of the needed roads, sewer systems, and water system from monies received from either grants and/or loans from the State of Indiana; Federal Highway funds; proceeds from Tax Incremental Financing; and other funds under County control. Auditor and Treasurer of County shall have duty to receive, disburse, and account for all monies. (P. 3)

Administration: The Joint I/N Tek Governmental Board shall administer the provisions of this agreement. It will consist of 3 members, namely: A) The President of the Board of Commissioners of St. Joseph County, who shall also be the President of the Board; B) The Mayor of the City of South Bend; and, C) The President of the Town Board of New Carlisle.

Board shall, by majority agreement, select the engineers and approve final design plans for each project, except that: 1) County shall have veto power over selection of engineers and final design plans for road project; 2) City shall have similar veto power pertaining to sewer project; and, 3) Town shall have similar veto power pertaining to water system project. (P. 3) All bids for projects shall be advertised, accepted, and awarded by County through its Board of County Commissioners. (P. 3)

Termination: May occur by unanimous agreement of the joint board and unanimous agreement of the legislative and executive bodies of County, City, and Town. (P. 3) If the state fails to provide County with adequate loans and grants, this agreement shall be null and void. (P. 4)
