Organization: Joint agreement. Governing board. Joint supply: City will make the services of its Crown Point Fire Department ("the Department") available to Township, and Township will supply fire fighting equipment (some of which it already has and some of which it must purchase under the terms of this agreement) to the City for the Department's use; Township will also pay annual fee to City.

Duration: January 31, 1995 through December 31, 1999. In the event document is not fully executed and approved prior to the date of commencement, it shall be deemed retroactive in force and effect to the date of commencement upon its full execution and approval. (P. 2)

Services delivered: Department will respond to fire alarms and calls received at its fire station so long as the location of the fire is accessible by roads reasonably safe for traverse by Department vehicles and personnel. (P 1)

Staffing and supplying: Township owns certain trucks and equipment (listed in Exhibit A at back of document) for which the City will provide adequate storage (at fire station or an auxiliary structure). Township will be responsible for paying all bills and invoices for fuel, lubrication, and maintenance for said trucks. Bills and invoices will be sent to Township directly. City can make use of this equipment at its complete discretion. Township shall provide liability insurance for said equipment and trucks, in such amounts and with such carriers as shall be approved by City. (P. 2)

Financing: In consideration of the fire fighting services provided, Township shall purchase for City the equipment listed in Exhibit B (not included in our copy). Payment for said equipment to be paid within first year of this contract. Said equipment shall be under the exclusive ownership of the Township. City shall be responsible for fuel, lubrication, and maintenance, and City shall provide liability insurance. City Department shall have complete discretion over use of this equipment. (P. 2) Additionally, Township shall pay to City the sum of $51,000 for each of the years 1995 through 1999 (inclusive; 5 such payments in all). Installments of one-fourth of the annual payment shall be made on or before: April 10, July 10, October 10, December 31. Township may elect to prepay any installments, or any part thereof, at any time before its due date, without penalty. (P. 3)

Administration: All departmental members will at all times be under exclusive control of City. City is responsible for compensation of all departmental employees. (P. 2) A joint board, membership which shall consist of the City's mayor, the City's fire chief, and the Township's trustee, shall administer the terms of this agreement. (P. 3)

Property: Real and personal property used by Department is acknowledged to be owned by City, except for those items of equipment and trucks owned by Township, as listed in the attached schedule. In the event of acquisition of any real or personal property for departmental use, the same shall be owned by the entity purchasing or acquiring the same. In the event of sale or disposal of property, the same shall be sold or disposed of by the respective entity which owns the same. (P. 3) Upon termination, all property owned by the Township shall be returned promptly to the possession and control of the Township. (P. 4)

Liability: "Failure to Respond" statement: City shall not be liable to Township or to any person or persons in damages for any failure by the Department, or by any employee thereof, to heed or respond to any alarm or call made or received in the duration of this agreement. (P. 4)
