Purpose: To provide fire protection, rescue, and emergency ambulance services to the Township. (P. 1)

Organization: Joint agreement. No governing board. Single supply: Town will provide rescue personnel, and Town owns and maintains equipment. (P. 1)

Duration: 1 calendar year (January 1, 1995 to December 31, 1995). (P. 1)

Financing: Two payments of $75,000 each will be made by the Trustee of Township to Town Council. First payment due and payable on June 30, 1995; second due and payable on December 31, 1995. (P. 1)

Administration: Emergency ambulance equipment and personnel of department under exclusive control of Town. Town shall furnish to Township a report of all fire, rescue, and emergency ambulance runs made in said Township. (Pp. 1-2)

Town Council shall, no later than July 15 of the year for which this agreement is in effect, notify Township Trustee of its affirmative or negative intent to extend this agreement for another year. If intent is in the affirmative, intended cost to be charged to Township shall be included. Township Trustee shall respond to notice within ten (10) days as to its acceptance or rejection of said offer. Said notices are not binding upon either party. If Town declines to extend services for another year, it must notify in writing the Public Protection Department, Insurance Services Office of Indiana of this decision. (P. 2)

Liability: No default under this contract shall be deemed to result when the rendering of any service is prevented or delayed by an emergency requiring the use of the above-mentioned equipment by the Town of Plainfield, or by any circumstances beyond its control. (P. 1)

Township Trustee is indemnified against any loss and damages that might result from failure of Town Council Members to comply with the statutory requirements of I.C. 36-8-12.1 through I.C. 36-8-12.12 (Volunteer Fire Companies). (P. 2)

Termination: Either party may unilaterally terminate contract at any time, given that the one party has granted the other six (6) months prior written notice. As well, if this contract is terminated by mutual consent, six (6) months prior notice in writing is required. (P. 2)
