Purpose: To institute a curbside recycling program.

Type: Collaboration
Organization: Multiple-party agreement. Governed by the Board of Directors of the Clark County Solid Waste Management District ("District"). [Composition of Board is nowhere mentioned.] Multiple supply: District will contract with vendor and provide decreasing amount of financing. Jurisdictions provide increasing amounts of financing, as well as personnel, materials, and information. All jurisdictions receive recycling services.
Duration: 4 years, commencing in January, 1994. (P. 2)
Staffing and supplying: Member jurisdictions agree to assign personnel, and to provide information
and materials as requested, to the District to assist in the vendor contract bidding procedure. (P. 5)
Financing: Payment of vendor contract over first 4 years will proceed as follows: a) District will bear full cost of bidding, initiating, coordinating, implementing, and managing contract; b) During first year, District will pay all costs; c) During second year, District will pay ½, other parties pay ½; d) During third year, District will pay 1/3, other parties pay 2/3; e) During fourth year, District pays 1/4, other parties pay 3/4; f) In any years after the initial 4-year term, District continues to perform responsibilities set forth in "a" above, other parties will be responsible for all other costs. agreement.] Each jurisdiction will establish a "recycling non-reverting escrow fund." These are
special, separate cash funds that will be the sole depository for user fees. Shall be the primary source
from which the parties shall pay their respective monetary obligations to District. (Pp. 4-5) District
is solely responsible for implementing a billing and collection procedure. All monies collected by
District shall be remitted to member jurisdictions in the net amount remaining after District deducts
respective payment obligations for vendor services. All monies so remitted shall be held in each
party's special escrow fund. (P. 6) District given monthly bank statements for each fund. Each party
may invest (for 3 months or less) its escrow fund monies if not presently due; income earned belongs
to that party. Fund monies expended only for payments due the District. Other expenditures possible
if (1) party has paid in full; (2) for recycling-related purposes, with majority approval of District
Board. So long as party has obligation to District, withdrawals of money require signature of
controller of District. (P. 8)
Administration: District is sole bidding party responsible for advertisement, awarding,
management, and coordination of payment. (P. 2) Parties agree to refrain from engaging in any
individual curbside recycling projects, unless they are approved by Board by a 3/4 majority. (P. 3)
Each jurisdiction is responsible for the civil prosecution of any ordinance violations. District is
entitled to notify the parties of any reported ordinance violation. (P. 5) If any participating unit
withdraws from, or fails to participate in, this agreement, District is entitled to take court action
