Purpose: To make the facilities of the Fort Wayne Department of Animal Control ("Department") available to County for the storage and/or disposal of cats and dogs.

Function: Health and human services, Animal control

Type: Collaboration

Organization: Joint agreement. No governing board. Single supply: City already runs an animal control facility and will make it available for use by County in return for an annual fee.

Duration: Until December 31, 1993. Automatically renews for one-year terms. (P. 2)

Services delivered: Department shall receive all animals delivered to it by Sheriff of Allen County or Allen County Animal Control Officer ("Control Officer"), except those animals deemed by Department management to be in need of immediate veterinary attention. Department shall provide suitable storage facilities for impoundment of said animals and provide such services as are appropriate. City shall dispose of said animals at the expiration of 3 business days after delivery and impoundment thereof. City laws and policies regarding the handling of animals delivered from outside city limits shall be consistent with those applied to animals received from within City limits. (P. 1)

Department agrees to provide on-site training to Officer in the handling and sheltering of animals. (P. 2)

Financing: County shall pay $34,000 to City for 1993. This sum shall be due and payable each subsequent year during the course of this agreement. Each year's payment due in full on or before January 31, covering services to be rendered through December 31 of that year. (P. 2) In the event that an owner of an animal delivered to the Department redeems said animal within the prescribed period, Department shall charge said owner according to the established fee schedule. (P. 2)

Administration: Department agrees to respond, at its discretion, to animal related emergencies outside the city limits within the confines of Allen County only when requested to do so by the Sheriff's Department. Such assistance will be provided only under the following conditions: a) Call is approved by a Department supervisor; b) Call is of an emergency nature (immediate public safety hazard or injured animal); c) Control Officer cannot be reached; d) department employee responding to call must be accompanied by an Allen County Police Officer. (P. 2)

Acceptance of this contract is dependent upon the execution of contracts between Department and Allen County Board of Health and Allen County Commissioners. Term of this contract concurrent with these other two. (P. 2)

Liability: Board of Commissioners of Allen County shall hold harmless the Department and City of Fort Wayne for any claims arising out of their and/or the Control Officer's negligence or error. (P. 2)

Termination: Can occur if: (1) any of the parties notifies the other in writing prior to May 1 of the year in which this agreement expires; (2) funds are at any time not forthcoming or insufficient. In latter case, County shall have right to terminate agreement without penalty by giving prior written notice documenting the lack of funding. (P. 3)
